Utah psychiatrist accused of fraudulent billing charged in CSAM investigation

OREM — A Utah psychiatrist charged with making false claims for medical benefits, is now accused of accessing child sex abuse material while awaiting trial.

Thomas Eugene Draschil, 49, of Orem, was charged Thursday in 4th District Court with seven counts of sexual exploitation of a minor, a second-degree felony.

According to the Utah Division of Professional Licensing, Draschil was first "licensed to practice as a physician and to administer and prescribe controlled substances" in 2015.

In 2018, however, Draschil "admitted he unlawfully possessed a controlled substance, was addicted to ketamine and marijuana, and engaged in inappropriate relations with a patient," the DOPL report states. He surrendered his license to the state at that time.

In 2022, Draschil was issued a "probationary license to practice as a physician/surgeon and to administer and prescribe controlled substances in the state of Utah."

In 2024, Draschil was charged in 3rd District Court with two counts of making false claims for medical benefits, a second-degree felony. In that case, he is accused of "falsifying medical records" while he was a supervisor and medical director for Measures of Affect Theoretically Relative, known as MATR, a behavioral health company offering substance use disorder treatment.

"Shortly after MATR was approved as a Medicaid provider, Medicaid revenue became the primary source of income for the company, and eventually became MATR's sole source of income," the charges state.

However, an analysis of Medicaid claims shows certain services that were billed "were not provided by qualified professionals, did not comply with Medicaid regulations and were based on false documentation," according to the charges.

That case is scheduled to go to trial on Dec. 1.

According to his new charges filed Thursday, law enforcers attempted to serve another search warrant on Draschil's home in August, but learned that he "no longer lived at the address and was homeless."

Draschil was located a few days later in Utah County and arrested and his phones were seized.

"At the time of his arrest, (Draschil) was unhoused. Law enforcement made significant efforts in order to locate (him), including serving a warrant at a prior address, talking to his ex-wife, applying for a ping warrant, and conducting surveillance," charging documents state.

Investigators learned that Draschil used his phone to access several email accounts, including one that contained child sex abuse material, according to the charges.

After charges were filed in 2024, Draschil again surrendered his license to practice to the state and agreed not to reapply for a license for three years.
