Will the Lindsay Clancy trial be retried? Judge hears motions today.
There have been several motions filed since the first case against Lindsay Clancy ended in a mistrial. The judge in the Clancy case is expected to resolve, or at the very least take a look at, all those motions today.
District Attorney Tim Cruz’s office has not announced whether it will re-try lindsay clancy for first-degree murder.
Clancy is accused of killing her three children, and her team argues she should not be held criminally responsible because she was dealing with postpartum psychosis due to being overmedicated and essentially ignored by doctors.
Although it’s uncertain if the case will be tried again, the DA’s office last week said they are still committed to pursuing justice for the three children.
Clancy’s lawyer, Kevin Reddington, hopes Judge William Sullivan will shoot down the idea, arguing that retrying her would violate her constitutional protection against double jeopardy, which bars anyone from being tried twice for the same offense.
Prosecutors disagree, and today’s session is expected to start at 9 a.m.
