HOUSTON, Texas (KTRK) -- A Harris County Precinct 4 deputy constable was arrested and charged with solicitation of prostitution following an undercover police operation in northeast Houston, according to court records.
According to authorities, the deputy, identified as Davien Montgomery, currently works for Harris County Constable Precinct 4.
According to Houston police, Montgomery was in the 3300 block of Tidwell Road on Monday while officers were conducting an undercover prostitution sting.
Court documents allege that Montgomery solicited oral sex from an undercover officer and agreed to pay $50.
Records state the two agreed to meet at a nearby motel.
Police said Montgomery was arrested after arriving at the agreed-upon location.
Montgomery made an initial court appearance Tuesday morning, during which a magistrate found probable cause.
"Mr. Montgomery, you got one charge on the docket; it's for solicitation of prostitution. I have looked at the case; I find there is enough probable cause. I will send you to court. Will you need a court-appointed attorney?" the magistrate said.
"No, sir," Montgomery responded.
ABC13 reached out to Mark Hermann's office for comment, but had not received a response as of Tuesday.
The charge remains pending.
