Former doctor photographed patients’ genitals during medical procedures, lawsuit alleges

TOLEDO, Ohio (WTVG/Gray News) - A Toledo doctor who has been indicted for possession of child sexual abuse material also photographed his patients’ genitals during medical procedures, according to a newly filed lawsuit.

Bryan Sack, former doctor and chief of pediatric urology at Nationwide Children’s Hospital in Toledo, was arrested earlier this year for allegedly having tens of thousands of explicit images of children.

According to a statement from Nationwide Children’s at the time of Sack’s arrest in February, the charges were not related to his work at the hospital.

The surgical photos in question were disclosed in an FBI affidavit in May, according to Flood Law, the firm representing the families.

A lawsuit has now been filed Nov. 4 on behalf of 13 children and their families, alleging that Sack’s Dropbox account had more than 27,000 files of children.

The lawsuit also states that 1,200 files of child sexual abuse material were found, along with close-up images of children’s genitals, including images Sack is accused of taking with his cellphone during examinations.

The lawsuit named Sack, Nationwide Children’s Hospital - Toledo, Nationwide Children’s Hospital and Mercy Health St. Vincent Medical Center as defendants.

Nationwide Children’s in Toledo operates on the Mercy Health Toledo campus.

The lawsuit claims invasion of privacy, intentional infliction of emotional distress, negligence, negligent supervision, negligent hiring, credentialing and retention against both hospitals, and fraudulent concealment against Nationwide Children’s.

In addition to financial compensation, the families want the hospitals to notify every patient Sack treated, audit the images he accessed, and require Sack to identify and hand over any patient image in his possession before evidence can be destroyed through federal forfeiture.

They also want counseling for affected children and their families to be paid for.

Sack was arrested after an investigation prompted by a tip from the National Center for Missing and Exploited Children. A search warrant was executed at his residence, where digital evidence was seized, authorities said.

According to Nationwide Children’s Hospital, Sack was terminated from his position following the reported charges.
